An arrest for stalking or harassment can be very serious. Stalking and harassment allegations can lead to a restraining order. Conviction may be a disorderly persons or indictable charge, depending on the circumstances, both of which can have life-changing consequences.
Stalking cases are often less dramatic than they are depicted in movies. In some cases, a domestic dispute can turn into a stalking charge, or a spurned partner may have gone too far. Stalking is defined as a course of conduct in which someone repeatedly or continuously threatens, observes, communicates with, or interferes with another’s property or privacy. The interference must cause a reasonable person to have significant distress or cause someone to reasonably fear for their safety under the law.
To be convicted of stalking, someone must have acted at least twice on different occasions. This form of harassment usually comes in the form of persistent phone calls, emails, letters, or gifts, observing the victim in a way to cause them fear, or making threats. In , stalking may be a second, third, or fourth degree crime.
There are many possible ways to defend yourself against a stalking charge. In many cases, a victim mistook the other’s intentions as a threat. Your attorney may be able to get your charge downgraded to harassment, which is a petty disorderly persons charge (misdemeanor).
Harassment is a charge that is similar to stalking but less serious. This petty disorderly persons crime is defined under the law as:
While it is usually a disorderly persons crime, harassment can become a fourth degree indictable offense (felony) if the harassment occurs while the defendant is on probation or parole for an indictable offense.
To be convicted of harassment, you must not only have committed the harassing act, you must also have had the intent to harass. courts have upheld that profanity or thoughtless words alone is not enough to show intent to harass, but the law is not precisely defined, as “annoying” or “alarming” can mean many things.
If you are convicted of harassment, you can face up to six months in prison and up to $1,000 in fines.

Mark did an amazing job representing us and helped us tremendously over the past year with our youngest. He kept us informed and truly put our minds at ease. We couldn’t have asked for a better outcome. We’ve known and used Mark for well over 20 years and will always recommend his services to family and friends.Posted on Google debi jansmaTrustindex verifies that the original source of the review is Google. Even one star is too much to rank this lawyer. My 89-year-old mother-in-law had an accident with her car and a fire hydrant in early January and was referred to Mr. Bernstein by a family friend. What should have been a very simple hearing and fine was postponed time after time until we intervened and communicated with him by text. Finally in late April, the hearing was held, but Mr. Bernstein couldn't show and said he would sent a colleague. His colleague never showed up and my mother-in-law was forced to go through the whole thing by herself. His office never called about any of the prior postponements and our family had to constantly track the appointments and cancellations. As others have posted, it's "money up front" and no customer service to speak of. UPDATE: we had a longer talk today with my MIL and it turns out that a "nice young man" came up to her after the morning break and let her know he would take care of the situation. He did get the charge pled down to just a fine. Not being familiar with the process of court hearings, she thought the person was the court clerk, but it turns out that was Mr Bernstein's colleague. So I do need to retract that portion of my review. I do still stand by the observations on lack of customer service, and communication skills.Posted on Google Andrew DesmaraisTrustindex verifies that the original source of the review is Google. Attorney Mark Bernstein is absolutely outstanding- I’d give him 50 stars if I could. I met him 3 years ago when he represented me for careless driving and got the charge dropped with no points on my record. I met him again last month when my 20 year old son was arrested for DUI and breathalyzer refusal charges along with about 8 other unfair charges. I called Mark at 7:30am on a Saturday morning the day after and he immediately answered my call, and listened to what happened in a caring and non- judgmental way. He quickly took action by postponing the court date, carefully reviewing the police report. webcam and transcript data. Importantly, he kept me informed each step of the way answering all my texts and phone calls with no more than a 5 minute wait. Before me and my son showed up in court Mark told us he already had the situation handled! Myself and my son only spent about 5 minutes in court and had the charges dropped including DUI and breathalyzer refusal charges. All this for a one time fee that was extremely fair. My son can move on without a permanent DUI charge on his record. If you are looking for an intelligent and caring but highly aggressive lawyer (in a good way!) who has your best interest at heart look no further…Mark is simply the best!!Posted on Google Joshua MartelTrustindex verifies that the original source of the review is Google. I was skeptical because it seemed like a third of the reviews were negative in some kind of way. As a military veteran, I found Mr. Bernstein very professional and courteous. I was facing ten years. Long story short, my case was dismissed and expediently expunged. I was lucky the plaintiff didn’t show up, but also lucky to find proper representation within his practice, As the state picked up my case, he got it dropped to a municipal level. If it wasn’t for him, I would probably be behind bars, but instead I get a second chance at life, spending the holidays with my daughters & family.
